1. About This Privacy Policy

This Privacy Policy describes how Replay Digital Inc. ("we," "us," or "our") handles information in connection with the AirVibe mobile application ("App"). We may update this policy periodically, and changes will be posted on this page with an updated effective date.

2. Information We Do NOT Collect

AirVibe is designed to operate without collecting personal information on our servers. We do not:

• Require account creation or login
• Collect or transmit data over the internet
• Store your profile, photos, or matches on our servers
• Use analytics, tracking, or advertising SDKs
• Share your information with third parties
• Track your location via GPS or network

3. Information Stored Locally on Your Device

The following information is stored only on your device and never transmitted to us:

Profile Information

• Name (optional - you can remain anonymous)
• Profile photo
• Your vibes/goals for matching
• "About Me" description
• "How to reach me" contact preferences

Match History

• Records of people you've matched with
• Chat messages exchanged with matches
• Match compatibility information

App Preferences

• Notification settings
• Event participation history

4. Peer-to-Peer Communication

When you use AirVibe to find matches nearby:

• Bluetooth Communication: Your device communicates directly with nearby devices running AirVibe using Bluetooth Low Energy (BLE). No internet or cellular connection is used.
• Encryption: All peer-to-peer data is encrypted using AES-256-GCM encryption before transmission.
• Profile Exchange: When matching, your profile information is shared directly with nearby users' devices. This data is not routed through any server.
• Temporary Nature: Profile data received from peers is held temporarily for matching purposes and is not permanently stored unless you match.

5. On-Device AI Processing

AirVibe uses Apple Intelligence for match compatibility analysis. This AI processing:

• Runs entirely on your device
• Never sends your data to cloud AI services
• Requires an Apple Intelligence-capable device (iPhone 15 Pro or later with iOS 18.1+)

6. Camera and Photo Library Access

AirVibe requests access to your camera and photo library solely to allow you to add a profile photo. Photos are:

• Stored locally on your device only
• Never uploaded to any server
• Shared only via direct Bluetooth connection with nearby users during matching

7. Bluetooth Permissions

AirVibe requires Bluetooth permission to discover and communicate with nearby users. Bluetooth is used exclusively for:

• Discovering other AirVibe users nearby
• Exchanging encrypted profile data for matching
• Sending and receiving chat messages with matches

AirVibe does not use Bluetooth for tracking, advertising, or any purpose other than direct user-to-user communication.

8. Notifications

If you enable notifications, AirVibe may send local notifications when:

• A new match is found nearby
• You receive a message from a match
• Someone pokes you

These notifications are generated locally on your device. No push notification servers are used.

9. Data Retention and Deletion

Since all data is stored locally on your device:

• Deleting the App: Uninstalling AirVibe removes all associated data from your device.
• Clearing Match History: You can delete individual matches or clear all match history within the app.
• Profile Reset: You can clear your profile at any time through the app settings.

We have no ability to access, retrieve, or delete your data because we never receive it.

10. Children's Privacy

AirVibe is not intended for children under 17 years of age. We do not knowingly collect information from children. Since AirVibe does not collect data on servers, there is no server-side data to delete. Parents who believe their child has used AirVibe can simply uninstall the app to remove all locally stored data.

11. International Users

AirVibe operates entirely on-device without transmitting data internationally or to any servers. Your data remains on your device regardless of your location.

12. Your Rights

Because AirVibe does not collect or store your personal information on our servers, traditional data subject rights (access, deletion, portability) are automatically fulfilled:

• Access: All your data is already on your device and accessible to you.
• Deletion: Delete the app to remove all data, or use in-app controls to delete specific information.
• Portability: Your data exists only on your device in your control.

13. Third-Party Services

AirVibe does not integrate with third-party analytics, advertising, or data collection services. The only third-party technology used is:

• Apple Frameworks: Core Bluetooth, MultipeerConnectivity, and Apple Intelligence (all operate locally on-device)
• App Store: Distribution through Apple's App Store is subject to Apple's privacy policy

14. User-Generated Content

AirVibe allows you to create and share user-generated content, including but not limited to profile photos, biographical information ("About Me"), meeting preferences ("How to reach me"), and vibes/goals. You understand and agree that:

• Your Responsibility: You are solely responsible for all content you create, share, or transmit through the App. You represent and warrant that your content does not violate any applicable laws, infringe upon the rights of any third party, or contain any harmful, offensive, defamatory, or inappropriate material.
• Peer-to-Peer Exchange: User-generated content is exchanged directly between users via peer-to-peer Bluetooth communication. Replay Digital Inc. does not receive, review, moderate, store, or have any control over user-generated content.
• No Endorsement: Replay Digital Inc. does not endorse, verify, or guarantee the accuracy, authenticity, or reliability of any user-generated content. Any reliance on content provided by other users is at your own risk.
• Interactions with Others: You are solely responsible for your interactions with other AirVibe users. Replay Digital Inc. is not responsible for the conduct, actions, or content of any user, whether online or offline.

15. Disclaimer of Liability and Assumption of Risk

BY DOWNLOADING, INSTALLING, OR USING AIRVIBE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

• Use at Your Own Risk: Your use of AirVibe and any interactions with other users are entirely at your own risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.
• Release of Liability: To the fullest extent permitted by applicable law, you hereby release, discharge, and hold harmless Replay Digital Inc., its officers, directors, employees, agents, successors, and assigns from any and all claims, demands, damages, losses, costs, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) any user-generated content you create, share, or receive; (c) any interactions, communications, meetings, or relationships with other users; (d) any conduct, actions, or omissions of other users; and (e) any harm, injury, or damages of any kind resulting from the foregoing.
• Waiver of Claims: You agree not to hold Replay Digital Inc. responsible for any disputes, claims, losses, injuries, or damages arising from or related to your use of the App or your interactions with other users. This waiver includes, but is not limited to, claims for personal injury, emotional distress, property damage, identity theft, fraud, harassment, or any criminal conduct by other users.
• Acknowledgment of Risks: You acknowledge that meeting strangers involves inherent risks. You agree to exercise caution and good judgment when interacting with other users and meeting in person. Replay Digital Inc. does not conduct background checks on users and makes no representations regarding user identity, character, or intentions.
• Indemnification: You agree to indemnify, defend, and hold harmless Replay Digital Inc. from any third-party claims arising from your use of the App, your user-generated content, or your violation of these terms or any applicable laws.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain types of damages. In such jurisdictions, the above limitations shall apply to the fullest extent permitted by law.

16. Changes to This Policy

We may update this Privacy Policy to reflect changes in our practices or for legal, operational, or regulatory reasons. We will post any changes on this page and update the effective date. We encourage you to review this policy periodically.
